Parties

This Performer Agreement and the Terms of Use for the website are legal documents evidencing a binding agreement between you and AROUSR. Upon successful completion of the application process and review by AROUSR, and should AROUSR accept your application, you will become a Performer, having access to the services offered on the website, under the policies, terms, and conditions set forth herein and in the Terms of Use agreement.

The policies, terms, and conditions set forth herein are specifically designed to limit any liability and/or legal obligations AROUSR may have to you. Further, these terms permit AROUSR to modify, alter, suspend, or terminate your access to and use of the services offered on the website for any reason or no reason at all. You are strongly encouraged to read all policies, terms, and conditions herein, along with the Terms of Use. By continuing onto the application page, you affirmatively acknowledge and agree to all of the terms contained herein.

1. Eligibility

The website is available only to persons who have attained the age of eighteen (18) years and are otherwise capable of entering into and forming a legally binding contract.

2. Assumption of Risk

To the extent permitted by law, the Performer agrees to release and hold harmless AROUSR, its related entities, shareholders, employees, agents, affiliates, and assigns from liability for any actions associated with your entry into the website and any actions as a Performer. This includes, but is not limited to, claims for damages, costs and expenses (including litigation costs and attorney’s fees) of every kind and nature, arising out of your actions as a Performer on the website.

3. Modifications and Termination

AROUSR may modify, alter, suspend, or terminate this Performer Agreement and your use of the website, for any reason or no reason at all, without prior notice to you.

4. Status as a Performer

A Performer is not an employee, agent, or contractor of AROUSR, nor shall a Performer represent or hold themselves out as any of the foregoing. The Performer is solely responsible for reporting and payment of all taxes associated with fees earned as a Performer with AROUSR and for procuring any equipment necessary to access the website and perform as a Performer.

5. Prohibited Activities

You are strictly prohibited from using our service or website to engage in, participate in, assist, support, or facilitate any act of prostitution, sex trafficking of children, or sex trafficking by force, fraud, or coercion. Any violation will result in immediate cancellation of your account, a permanent ban from the platform, and forfeiture of payments. We will cooperate fully with any criminal investigation by police or government agencies. If you are engaged in, participating in, or facilitating any such activity, you must immediately cease all such conduct.

6. Access to Website

You agree to maintain the confidentiality of your password and account information and to be directly responsible for all activity conducted under your account. You may not permit any other person to access the website or act as a Performer under your account. You agree that:

a) You are solely responsible for the content of all communications with customers on the website.

b) You are solely responsible for the content of your profile.

c) You will not share personal contact information or alternative payment methods with customers (e.g., private phone numbers, email, messaging apps, or payment services such as PayPal, Western Union, etc.).

d) All services sold to a customer must be paid using the AROUSR Credits System. Attempting to bypass this system will result in immediate termination of your account.

e) You will not use the website for illegal purposes or in violation of this Agreement or the Terms of Use. You will cooperate fully with AROUSR or law enforcement as required.

f) You will provide accurate and complete payment and contact information at all times and will not use any unauthorized identity.

g) You will not promote any product or service not contained in your approved Performer profile.

7. Performer Profile and Content Restrictions

While using the website, you may not engage in any conversation, communication, or content creation (including images, videos, or live streams) concerning minors, bestiality, rape, incest, snuff, necrophilia, blood, asphyxiation, vomit, chloroform, weapons, drugs, intoxication, scatology, violence, or any activity deemed obscene or involving child pornography. You must not encourage or permit customers to do the same. You must comply with all applicable laws and regulations concerning your content, including age and identity verification as required by law.

8. Content Ownership and License

AROUSR owns all rights, title, and interest in the Performer Services as contained on the website, including but not limited to methods, processes, content, formats, designs, URLs, phone numbers, and all related intellectual property rights. No copyright, patent, trademark, or license rights are conferred to the Performer except as needed to access the website and services.

9. Phone Numbers

You have no right, title, or interest in any phone numbers or extensions assigned to you by AROUSR. AROUSR may change or reassign these at any time, for any reason.

10. Content License

By uploading content to AROUSR, you grant AROUSR an unconditional and unlimited license to use, reuse, publish, and republish any text, images, videos, or multimedia content you submit. You grant AROUSR, its affiliates, and partners the right to use, copy, distribute, display, or reference your listing information, including name, tags, photos, phone numbers, and extensions. Once posted on the website, content may be copied, published, or cached by search engines or third parties. AROUSR is not responsible for the manner in which third parties use or disseminate your content.

11. Warranties

AROUSR disclaims all warranties relating to the website and Performer services. All services are provided “as-is.” AROUSR is not liable for any indirect, incidental, or consequential damages, nor for interruptions or errors. You agree to hold harmless and indemnify AROUSR for any liability arising from your use of the website or provision of Performer services.

12. Copyrights and Trademarks

You may not use copyrighted materials or trademarks without authorization. You must not upload or store material that infringes intellectual property rights.

13. Assignment

You may not assign any rights or obligations under this agreement. AROUSR may assign this agreement at its discretion.

14. Relationship of the Parties

Nothing in this agreement creates an employment, agency, or contractor relationship between you and AROUSR. You may not bind AROUSR to any legal or contractual obligation.

15. Electronic Documents

You consent to the use of electronic means to complete this agreement and to receive notices. You may request a paper copy of this agreement by writing to AROUSR, P.O. Box 34518 CSP Place Vertu, Saint-Laurent (QC) H4R 2P4 Canada.

16. Severability and Waiver

If any part of this agreement is found invalid, the remaining provisions remain in effect. AROUSR’s failure to enforce any part of this agreement is not a waiver of its rights.

17. Content Provider Legal Compliance and Consent

a) Prohibited Activities: You are strictly prohibited from uploading, generating, or facilitating any content or activity that is illegal or otherwise violates applicable law, website policies, or industry standards.

b) Consent Requirements: You agree and warrant that for all content you upload, create, or transmit on the website:

• • Consent to Depiction:You have obtained and retain written consent from every person depicted in the content to be depicted in such content.
• • Consent to Distribution:You have obtained and retain written consent from every person depicted in the content to allow for public distribution of the content, including uploading to this website.
• • Consent to Downloading (if applicable):If the content will be made available for downloading by users, you have obtained and retain written consent from every person depicted in the content for such downloading.

c) Age Verification: You have verified the identity and age of all persons depicted in the content to ensure all are adults (at least 18 years old or the age of majority in their jurisdiction, whichever is higher), and you will provide supporting documentation upon request by AROUSR or any competent authority.

d) Record Keeping: You agree to maintain accurate records of all required consents, age/identity verifications, and supporting documentation for all content, and to provide such records upon request.

e) Cooperation with Investigations: You agree to cooperate fully with AROUSR, law enforcement, and any relevant regulatory bodies in connection with any investigation or compliance review regarding content you have uploaded or generated.

18. Content Removal and User Rights

• • As a Performer, you may remove any of your own uploaded content (images, videos, profile information, etc.) at any time through your account/app interface.

• • If you are unable to remove content for any reason, you may request removal by contacting [email protected] and AROUSR will remove the content within 7 business days.

• • AROUSR will promptly review and remove any content upon valid request from a person depicted, whether or not that person is the Performer.

• • Violation of these rules may result in immediate suspension or termination of Performer status.

19. Jurisdiction and Entire Agreement

This Agreement and the Terms of Use shall be governed and interpreted in accordance with the laws of the Province of Quebec, Canada. This Agreement, together with the Terms of Use, constitutes the entire agreement between AROUSR and the Performer.
